FDA Regulations & what it means to your vape

On May 4th, 2016 the Food and Drug Administration, FDA, released  its final regulations clarifying vapor products and vaping accessories as tobacco products.  These regulations also states that any product introduced after February 15, 2007 will be subject to very strict regulations.

The FDA regulations went into place  August 8, 2016. Although there are some changes made in the stores, let us reassure you we are not going anywhere and we are still your one stop shop for all things vape. Under the new regulations things like juice sampling, re-cottoning your coils, and cleaning your tank have new guidelines. We are proud to still be able to help you with your journey through vaping and we will continue to give you the best of what we have to offer everyday.

What to expect when you visit an Alohma store

Under the FDA regulations electronic cigarettes are now considered a tobacco product.  Due to this change we can no longer allow free juice sampling. There is a .50 cent charge for a day pass that will allow you to sample as many juice as you would like or you can purchase your very own Alohmaverse member card for $5 that will you the ability to try juices 12 different times.  

Although we have always had a strict policy of only selling to people 18 years of age or older, 21 and older in certain states, the rule has been taken a step further. No one under the age of purchase is allowed in the store with out  a parent or legal guardian.  Also, no minors are allowed to be in the testing area.

What about mail orders?

We still do mail orders only now we have streamlined it!  To get a mail order please call (402)671-5758 Monday- Friday 9:00am-5:00pm or email us at shipping@alohma.com.  You can call after hours and a member of our shipping team will call you back the next business day. However, due to state laws there are certain states we can no longer ship to or they will require different packaging or showing ID upon arrival.  When you call us to place your order we will walk you through what the laws are for your state.

There are now certain states we cannot ship to California, Pennsylvania, Indiana, Arkansas, Montana, Utah, and Washington DC.  We cannot ship to these states because of the laws created by these states.  If you live in one of these states email, write, or call your local representatives and ask them for help.  Ask them to support H.R. 1136 to over turn the laws for your state. 

How do the regulations effect the juice?

On July 26, 2016, the Children’s Nicotine Poisoning Prevention Act (CNPPA), Pub. L. 114-116, 130 Stat. 3 (Jan. 28, 2016), will become effective and will require manufacturers of nicotine-containing e-liquids to comply with the child-resistant packaging and testing requirements set forth in the Poison Packaging Prevention Act of 1970 (PPPA), Pub. L. 91-601, 84 Stat. 1,670 (Dec. 30, 1970).

This means all juice containers must be child safe, be certified as such, and have an FDA & CNPPA approved advisory statement about nicotine being an addictive substance.  Although we are still able to get you all of the amazing juices you have come to expect from us, the bottles sizes have changed.  Currently 30ml and 50ml bottles are available and we will honor the 120ml and 500ml pricing even if you do have to get a bit creative as to how many bottles you get :).

Although more regulations and rules are coming (different package and labeling) when it comes to juice there is a possibility of flavors outside of standard tobacco and menthol tobacco being banned from the market.  Earlier this year FDA officials were looking at to ban all flavors beacause they saw that the flavors as a way of marketing to minors.  The vape community stepped up to fight this ban and the motion has been set aside for now but, the FDA has said it will revisit this topic at a later time.  

What happens next?

August 8th,2016-no new product can be introduced for sale unless a Pre-market Tobacco Application(PMTA) is processed & approved. The market will freeze.  Although we can still get in things that are new to alohma, new devices, tanks, and juices being introduced on the the vaping scene will not be allowed unless they have a PMTA which is a long and expensive process.  

3-24 months (after 8/8/2016)-based on information project by vape advocacy groups, some vendors will exit the market due to excessive fees & application time requirements.  Even if manufactures can raise the money needed for the PMTA it does not guarantee approval.  The FDA can still deny the product.  

24+ months-it has been estimated that by 24 months after the FDA regulations begin 99% of vendors and shops will be closed because of failure to obtain PMTA.

HR 2058 can help

HR 2058 will change the predicate date from February 15, 2007 to August 8, 2016.  Although it will not stop the FDA from regulating future vaping products, it will prevent 99% of products currently on the market from getting banned. Call your local representatives, congressmen, and senators and write them explaining why vaping is so important to you and why they need to support HR 2028.n your next visit to alohma ask the team for more information and what else we can do to save the vape industry.  We will help give you  a good place to start and let you know what the next step is.

The Cole/Bishop Bill

The Cole Bishop Bill. also known as H.R. 1136,  was introduced on February of 2017 and like HR 2058 it is looking to change the date on the FDA regulations.  With the FDA’s approach of regulating every device and juice on the market pry to 2007.  For more information about the new bill please click the link below.

A Billion Lives
