AGREEMENT BETWEEN USER AND Alohma
The Alohma Web Site is comprised of various Web pages operated by Alohma.
The Alohma Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the alohma Web Site constitutes your agreement to all such terms, conditions, and notices.
MODIFICATION OF THESE TERMS OF USE
alohma reserves the right to change the terms, conditions, and notices under which the alohma Web Site is offered, including but not limited to the charges associated with the use of the alohma Web Site.

The alohma Web Site may contain links to other Web Sites (“Linked Sites”). The Linked Sites are not under the control of alohma and alohma is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. alohma is not responsible for webcasting or any other form of transmission received from any Linked Site. alohma is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by alohma of the site or any association with its operators.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the alohma Web Site, you warrant to alohma that you will not use the alohma Web Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the alohma Web Site in any manner which could damage, disable, overburden, or impair the alohma Web Site or interfere with any other party’s use and enjoyment of the alohma Web Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the alohma Web Sites.
USE OF COMMUNICATION SERVICES
The alohma Web Site may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:
- Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

alohma has no obligation to monitor the Communication Services. However, alohma reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. alohma reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.
alohma reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in alohma’s sole discretion.
Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. alohma does not control or endorse the content, messages or information found in any Communication Service and, therefore, alohma specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized alohma spokespersons, and their views do not necessarily reflect those of alohma.
Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

TERMINATION/ACCESS RESTRICTION
alohma reserves the right, in its sole discretion, to terminate your access to the alohma Web Site and the related services or any portion thereof at any time, without notice. I am Sam Salaymeh, the founder of Alohma LLC and a passionate vaper! Alohma is my venture into the world of electronic cigarettes.
Genesis…
In mid-2011 I started vaping when a friend introduced me to electronic cigarettes. These cool inventions had tremendous potential. So I invested in learning more about them and how they could make my life better. After countless hours reading, sampling, testing, mixing, breaking, etc. (you get the point), I realized that it’s quite a journey for a vaper to figure out what they like the best… Trying each of the many options felt like a waste of time and money, not to mention creating frustration! But I was determined to get to the bottom of it. Within a short while I became the guy that people would call before they made a decision on what to try or buy… Soon after the requests became, “hey could you just order that for me.”
So… I decided to start a small business that would custom tailor a vaping solution to each and every customer. I envisioned meeting with my customers to listen to what they like, dislike, goals, and lifestyle. I would then share my experience with the various vaping products and work with customers to compile the best combination to address their goals and fit their lifestyles… happy customers within an hour of conversation and customization.
Fast forward…
I am in business now making customers happy every day. The process has been fantastic and the enthusiasm of my customers has been my fuel. I am building an inventory that will ensure that any item my customers want is always in stock at a great price.

We are almost 40 Plumers strong with 3 locations in the Omaha/CB metro to serve our customers. Our affiliates and wholesale program are serving several other communities. We are looking forward to serving more of our communities and further expansion in 2014.
May 2014…
We are a family of over 60 Plumers that run 4 locations in the Omaha/CB metro to serve our community. Our wholesale and distribution program is reaching several states and is placing our products in more and more brick and mortar stores. Our local community helped us grow so we are now working on paying back with efforts and contributions to research, events, and the helping our neighbors.

We changed our name from Plumes to Alohma 🙂
Here’s the scoop… We have been blessed with growth beyond our wildest dreams in the short amount of time we have been open. We are now embarking on a new journey of expansion into several states and maybe internationally. With that in mind, we decided that we needed a name that is very uniquely ours and cannot be in any way confused with anything else.
So with these thoughts… we locked a bunch of vape geeks into a room, loaded them up on sugar, caffeine, gave them a few key elements to include in the name, then sat back and watched as their minds started working. What we wanted our name to reflect was:
We are a company born and raised in OMAHA. We are a bunch of GEEKS. We started as PLUMES. We love helping PEOPLE
It was a challenge combining all those things into one word that flows easily, it quickly became apparent that no such word existed so we had to make one up.
Here’s how we did it:
Take the letters of OMAHA and scatter them around while making sure that O, H, and M are next to each other, just because we are geeky like that. Then we took the iconic swirly L from Plumes and put it in the mix just to remind us of our origin. The creation of alohma, a name to honor everything that is Plumes. A happy coincidence it’s very similar in sound to the word “people” in other languages around the world. How can you go wrong with that!

READ CAREFULLY
CAUTION: Batteries may explode or leak, and cause burn injury if recharged with an incompatible charger, disposed of in fire, mixed with a different battery type, inserted backwards, disassembled or stored with coins, keys, or other metals in your pocket.
Replace all used batteries at the same time. Keep in original package until ready to use. Do not carry batteries loose in your pocket or purse. Do not remove or replace the battery wrap.
Never use or charge a battery that has been damaged. Once fully charged, remove battery from charger.
BATTERY STORAGE AND HANDLING: Do not store loose batteries in your pocket. Keep loose batteries in a case to prevent contact with metal objects. Do not let batteries come in contact with coins, keys, or other metals in your pocket.
USE OF VAPOR PRODUCTS
- Make sure you read and understand the manufacturer’s recommendations for use and care of your device. If your vape did not come with instructions or you have further questions, contact the manufacturer.
- Don’t remove or disable safety features—like fire button locks or vent holes—that are designed to prevent battery overheating and explosions.
- Only use batteries recommended for your device. Don’t mix different brands of batteries, use batteries with different charge levels, or use old and new batteries together.
- Charge your vape on a clean, flat surface, away from anything that can easily catch fire and someplace you can clearly see it—not a couch or pillow where it is more prone to overheat or get turned on accidentally.
- Protect your vape from extreme temperatures by not leaving it in direct sunlight or in your car on a freezing cold night.
- Never charge your vape device with a phone or tablet charger. Always use the charger that came with it.
- Don’t charge your vape device overnight or leave it charging unattended.
- Replace the batteries if they get damaged or wet.
If your vape device gets damaged and the batteries are not replaceable, contact the manufacturer.
FDA Regulations & what it means to your vape
On May 4th, 2016 the Food and Drug Administration, FDA, released its final regulations clarifying vapor products and vaping accessories as tobacco products. These regulations also states that any product introduced after February 15, 2007 will be subject to very strict regulations.
What to expect when you visit an Alohma store
Under the FDA regulations electronic cigarettes are now considered a tobacco product. Due to this change we can no longer allow free juice sampling. There is a .50 cent charge for a day pass that will allow you to sample as many juice as you would like or you can purchase your very own Alohmaverse member card for $5 that will you the ability to try juices 12 different times.
Although we have always had a strict policy of only selling to people 18 years of age or older, 21 and older in certain states, the rule has been taken a step further. No one under the age of purchase is allowed in the store with out a parent or legal guardian. Also, no minors are allowed to be in the testing area.
What about mail orders?
We still do mail orders only now we have streamlined it! To get a mail order please call (402)671-5758 Monday- Friday 9:00am-5:00pm or email us at shipping@alohma.com. You can call after hours and a member of our shipping team will call you back the next business day. However, due to state laws there are certain states we can no longer ship to or they will require different packaging or showing ID upon arrival. When you call us to place your order we will walk you through what the laws are for your state.
There are now certain states we cannot ship to California, Pennsylvania, Indiana, Arkansas, Montana, Utah, and Washington DC. We cannot ship to these states because of the laws created by these states. If you live in one of these states email, write, or call your local representatives and ask them for help. Ask them to support H.R. 1136 to over turn the laws for your state.
How do the regulations effect the juice?
On July 26, 2016, the Children’s Nicotine Poisoning Prevention Act (CNPPA), Pub. L. 114-116, 130 Stat. 3 (Jan. 28, 2016), will become effective and will require manufacturers of nicotine-containing e-liquids to comply with the child-resistant packaging and testing requirements set forth in the Poison Packaging Prevention Act of 1970 (PPPA), Pub. L. 91-601, 84 Stat. 1,670 (Dec. 30, 1970).
This means all juice containers must be child safe, be certified as such, and have an FDA & CNPPA approved advisory statement about nicotine being an addictive substance. Although we are still able to get you all of the amazing juices you have come to expect from us, the bottles sizes have changed. Currently 30ml and 50ml bottles are available and we will honor the 120ml and 500ml pricing even if you do have to get a bit creative as to how many bottles you get :).
Although more regulations and rules are coming (different package and labeling) when it comes to juice there is a possibility of flavors outside of standard tobacco and menthol tobacco being banned from the market. Earlier this year FDA officials were looking at to ban all flavors beacause they saw that the flavors as a way of marketing to minors. The vape community stepped up to fight this ban and the motion has been set aside for now but, the FDA has said it will revisit this topic at a later time.
What happens next?
August 8th,2016-no new product can be introduced for sale unless a Pre-market Tobacco Application(PMTA) is processed & approved. The market will freeze. Although we can still get in things that are new to alohma, new devices, tanks, and juices being introduced on the the vaping scene will not be allowed unless they have a PMTA which is a long and expensive process.
3-24 months (after 8/8/2016)-based on information project by vape advocacy groups, some vendors will exit the market due to excessive fees & application time requirements. Even if manufactures can raise the money needed for the PMTA it does not guarantee approval. The FDA can still deny the product.
24+ months-it has been estimated that by 24 months after the FDA regulations begin 99% of vendors and shops will be closed because of failure to obtain PMTA.
How do we help?
HR 2058 can help
HR 2058 will change the predicate date from February 15, 2007 to August 8, 2016. Although it will not stop the FDA from regulating future vaping products, it will prevent 99% of products currently on the market from getting banned. Call your local representatives, congressmen, and senators and write them explaining why vaping is so important to you and why they need to support HR 2028.n your next visit to alohma ask the team for more information and what else we can do to save the vape industry. The Cole/Bishop Bill
The Cole Bishop Bill. also known as H.R. 1136, was introduced on February of 2017 and like HR 2058 it is looking to change the date on the FDA regulations. There is a three month warranty for most battery operated devices. Some items may not be eligible for service due to misuse, damage, or other failures caused other than by manufacturer defects or premature failure. There is no warranty on cartomizers, atomizers, tanks, coils, drip tips, disposables, or any similar product unless it was DOA when you received it.
OUT OF WARRANTY
At this time we are not servicing any items that are out of warranty. Please ensure that your device is within warranty prior to shipping your item.
TURNAROUND TIME
Turnaround time for evaluation and service is between 3-4 weeks from the day Madvapes receives your shipment.
For out of stock items, please allow 6-8 weeks for processing.
SHIPPING FEES
You are responsible for the cost of shipping your item to Madvapes. If your item is covered under warranty, return shipping will be provided at no charge. If your item is not covered under warranty, you will be responsible for any costs associated with return shipping.
DISCLAIMER
Some items may not be eligible for service due to misuse, damage, or other failures caused other than by manufacturer defects or premature failure. Alohma reserves the right to deny any warranty service. Please check the warranty prior to shipping. You are responsible for shipping costs to Alohma, and you understand that you will forfeit your item if you do not wish to pay for return shipping once Alohma has received your item, and it has been deemed that it is not covered under warranty.
